BICYCLE RENTAL, TOURS & EVENTS AGREEMENT – NOVA SCOTIA

This Bicycle Hire Agreement (“Agreement”) is entered into by and between Salt Air Cycle (“the Company”), operating in Seaforth and the Halifax Regional Municipality, Nova Scotia, and the hiree (“the Renter”). By completing a booking online, the Renter expressly agrees to all terms set forth herein.

1. ACCEPTANCE AND INCORPORATION

By taking possession of the equipment, the Renter acknowledges that the rental is governed by these terms and warrants that the equipment—including tires, brakes, and battery levels—is in good working order. All participants must sign a comprehensive Release of Liability and Assumption of Risk Waiver prior to receiving equipment. Failure to sign the waiver will result in the cancellation of the booking without a refund.

2. RENTER LIABILITY AND EQUIPMENT CARE

Salt Air Cycle does not provide insurance coverage. The Renter is 100% liable for all damage, theft, or loss of the bicycle and its accessories, regardless of fault. This liability includes the full retail cost of professional parts and labor for repairs. A minimum $150 assessment fee applies to any damaged return, while specific damage to frames or specialized paint will incur a minimum $250 refinishing charge. In the event of theft or total loss, the Renter will be charged the full current market replacement value. For overnight rentals, equipment must be stored in a dry, secure covered location, as the Renter is strictly liable for any moisture-related electrical damage.

3. USE RESTRICTIONS AND ROAD SAFETY

Bicycles must stay on paved roads or maintained crusher-dust trails, such as the Salt Marsh and Atlantic View Trails. Riding on beaches, sand, or immersion in salt water is strictly prohibited and will result in a $45 deep-cleaning surcharge. The Renter agrees to abide by the Nova Scotia Motor Vehicle Act, which mandates that CSA-approved helmets be worn at all times. Riders must be at least 16 years of age to operate e-bikes and must not operate the bicycle under the influence of alcohol or drugs. The Renter certifies that all members of their party possess the physical ability and technical skill required to safely operate the equipment.

4. RENTAL PERIOD, LATE FEES, AND RECOVERY

The rental period begins and ends at the confirmed times. Because bicycles are often booked for subsequent guests, punctuality is essential; late returns will be charged at $30 per hour or part thereof unless agreed on in writing for a later return. While riders are provided with a flat tire replacement kit, if Salt Air Cycle is required to provide roadside recovery or transport due to a flat tire, accident, or equipment mistreatment, a $50 recovery fee will be charged.

5. PAYMENT, CANCELLATION, AND AUTHORIZATION

Full rental payment is due at the time of booking, and a valid photo ID and credit card must be presented for a security hold. Cancellations made by the guest within 7 days of the hire period are non-refundable, regardless of weather or personal emergencies. Salt Air Cycle reserves the right to cancel a booking or substitute equipment for safety or availability reasons, in which case a full refund or credit will be provided. The Renter hereby authorizes Salt Air Cycle to charge the credit card provided for any and all liabilities arising under this agreement, including repair costs, replacement values, late fees, and cleaning charges.

6. LIMITATION OF LIABILITY AND GOVERNING LAW

The Renter acknowledges that cycling involves inherent risks and that Salt Air Cycle is not liable for personal injury, property damage, or loss arising from the use of the equipment. Furthermore, the Renter agrees to indemnify, defend, and hold harmless Salt Air Cycle Ltd. and its staff from any and all claims, demands, or costs—including legal fees—arising out of the Renter’s use of the equipment or any breach of this agreement. This Agreement is governed by the laws of the Province of Nova Scotia, and any disputes shall be subject to the exclusive jurisdiction of the courts in the Halifax Regional Municipality

  • Unforeseen Events: Salt Air Cycle shall not be held responsible for any event outside of its control, including but not limited to collisions, inclement weather, trail conditions, illness, injury, or loss/damage to personal property.

  • Cancellations: Salt Air Cycle reserves the right to cancel any trip due to safety concerns or low participation. In such cases, a full refund of payments received constitutes full settlement.

  • Itinerary Changes: Due to weather or trail maintenance, we may need to adjust the stated itinerary. We will endeavor to keep changes to a minimum while maintaining the quality of your experience.
